Do I Need Planning Permission for a New Roof?

For most homeowners in Merseyside, re-roofing is permitted development and requires no planning permission. But there are important exceptions — here is a clear guide to when permission is and is not required.

The planning status of roof replacement work is one of the questions we are asked most frequently, and the answer is more straightforward for most homeowners than they expect. This guide explains when planning permission is required, when it is not, and the situations where checking before you start is strongly advisable.

Important: planning rules change, and this guide reflects our understanding of the rules as they apply in most cases. We are roofing contractors, not planning consultants. For any situation where you are in doubt, always verify with your local planning authority before proceeding. This is particularly important for listed buildings and conservation areas.

The general rule: permitted development

In England, planning legislation includes a category of works known as permitted development — works that can be carried out without applying for planning permission because Parliament has already granted a general permission for them. The repair and replacement of a roof using the same or similar materials falls within permitted development rights for most domestic properties.

What this means in practice is that for the majority of homeowners in Formby, Southport, Liverpool, Crosby, Maghull and Ormskirk, replacing a roof — whether in the same material or a broadly similar one — does not require a planning application.

Permitted development rights are, however, subject to conditions and limitations, and they do not apply universally. The exceptions below are important and should be checked before you assume your planned works fall within them.

When planning permission may be required

Listed buildings

Any works to a listed building that affect its character, appearance or historic fabric require Listed Building Consent, regardless of whether the works would otherwise be permitted development. This includes like-for-like repairs, material changes and structural alterations. Carrying out works to a listed building without the required consent is a criminal offence. Always apply for Listed Building Consent before beginning any roofing work on a listed property.

Conservation areas

Properties within designated conservation areas may require Conservation Area Consent for roof alterations, particularly where these involve a change of material that would affect the character of the area. Merseyside has a number of conservation areas — parts of Formby, Southport and Liverpool city centre among them. Check with your local planning authority if your property is within a conservation area.

Changing roof structure

Altering the structure of a roof — changing its pitch, raising the ridge line, adding a roof extension or converting a hip to a gable — goes beyond simple replacement and may require planning permission regardless of the property type. These structural changes affect the external appearance of the building and are assessed differently to like-for-like re-roofing.

Flats and converted properties

Permitted development rights for flats are more limited than for houses. If your property is a flat, or a house that has been converted into flats, the permitted development rules that apply to houses may not apply. Consult your local planning authority before proceeding.

Properties where permitted development has been removed

Some properties have had their permitted development rights removed by a condition attached to a previous planning permission. This is more common on newer housing developments. Check the planning history of your property if you are unsure.

Material changes in sensitive areas

Even where a property is not listed or in a conservation area, a significant change of roofing material — for example, from traditional clay tile to a visually different modern tile — may prompt a planning authority to take an interest. If in doubt, seek prior approval.

West Lancashire Borough Council handles planning for Ormskirk and the surrounding L39 area.

Our position on planning

We always advise customers to check the planning position where there is any doubt before commissioning re-roofing work. We will not knowingly carry out work that requires planning permission without that permission being in place. We advise during our free survey if we believe a planning check is needed.

What about building regulations?

Planning permission and building regulations are separate considerations. Building regulations set standards for the technical performance of construction work, covering structural adequacy, fire safety, insulation and other matters. Certain roof replacement works — particularly those that affect the thermal performance of the building or involve structural changes — may require building regulations approval even where planning permission is not needed.

For a straightforward re-roof in the same or similar material, building regulations approval is generally not required. For work that changes the roof structure, adds insulation or involves significant alteration to the building fabric, approval may be needed. Your local building control department can advise.
